Terms & Conditions for User-Generated Content
These Terms and Conditions for User-Generated Content apply between Once Channel and the USER, ruling the use of the application or website.
The term USER means any person who uses the website or application.
By interacting with Once Channel, the USER agrees to these Terms and Conditions for User-Generated Content. The USER also understands there is no tolerance for inappropriate content, nor toward those who disregard the Terms and Conditions for User-Generated Content or other applicable rules and policies.
By not agreeing to the Terms and Conditions for User-Generated Content, the USER will not have the right to interact with the online platform.
Once Channel reserves the right to modify these Terms and Conditions for User-Generated Content without prior notice and to publish the revised version, the modifications of which shall become effective immediately. Therefore, the USER should frequently review the Terms and Conditions for User-Generated Content.
The USER agrees and acknowledges the use and processing of any personal data associated with the User’ Content according to our privacy policies.
USER LIABILITIES AND CONDITIONS
Once Channel do not tolerate inappropriate content. If the USER finds messages with inappropriate content, criminal or that is in disagreement with the UGC, Terms of Use or any other policies, they can report it through our website or application.
User agrees not to post and promote any objectionable, illegal, inappropriate, or otherwise construed, content or behavior.
EXAMPLES OF QUESTIONABLE, ILLEGAL AND/OR INADEQUATE CONTENT:
(i) Offensive, defamatory, libelous, abusive, threatening, hateful, violent, sexual, pornographic, racist, xenophobic, neo-Nazi, sexual or religious intolerance (of any kind) or obscene language content;
(ii) Text or audio messages, comments, chat room messages or using nicknames linked to child pornography, sexual exploitation of minors, pedophilia or adult content that may appeal to children;
(iii) Post text or audio messages, comments, exchange messages in the chat room or use nicknames that condone illegal activities or that incite crime, including, but not limited to, content of cruel practices against animals, that infringes the rights of third parties (such as copyrights, trademarks and privacy), which promote the use or sale of illegal or regulated substances (such as tobacco, alcoholic beverages, medicines, marijuana and its derivatives, legalized or not, ammunition, fire weapons) and that promote gambling (such as casino, sports books, bingo or poker);
(iv) Commercial messages, spam, or that advertise or facilitate the sale of financial services.
EXAMPLES OF QUESTIONABLE, ILLEGAL AND/OR INADEQUATE BEHAVIOR:
(i) Disclose information about illegal activities or activities that incite crime, bigotry, violence and hatred;
(ii) The use of offensive or racist language as well as the dissemination of material containing libel, slander and defamation and also abusive or that invades the privacy of third parties;
(iii) Ideological falsehood: access the chat room, send a message or comment trying to impersonate an administrator, guest, interviewee or employee;
(iv) use of the comment box, message board or chat room for expressions of hatred or intolerance, offenses to other users or any other act that may be qualified as violent or that promotes violence;
(v) Conduct that interferes with physical and mental health in any way, including, but not limited to, bullying or encouraging bulimia, anorexia and/or suicide;
(vi) “Flood” practice: sending the same message over and over again in a short period of time;
(vii) Access the chat room through automated systems and/or robots;
(viii) Sending messages or comments by manual, automatic and/or robot systems.
To ensure compliance with the above rules, Once Channel may block IP addresses to restrict access to the chat room, website or application, as well as notify the authorities, providing all necessary information for the investigation.
Moderation of objectionable, illegal and/or inappropriate content and behavior includes, but is not limited to, the above examples in their entirety.
ONCE CHANNEL LIABILITY
(i) Moderate the chat room, message board, and comments box to ensure compliance with the rules outlined in these Terms and Conditions for User-Generated Content.
MISCELLANEOUS
(i) Once Channel does not endorse the content of USERS communication. Therefore, it is not responsible for any illegal and/or defamatory material that violates privacy rights. Once Channel is neither liable for abusive, threatening, obscene, discriminatory, offensive, or objectionable content in any way and for those that infringe or will infringe any right whatsoever;
(ii) Once Channel is not responsible for the opinions and comments of the USERS, including but not limited to text or audio messages, chat room messages, or comments. The content of each is the sole and exclusive responsibility of the person who sent it;
(iii) Once Channel is not liable for any damages and losses from the non-compliance with the Terms and Conditions for User-Generated Content. If Once Channel becomes aware or receives notice of any conduct that goes against the provisions of the Terms and Conditions for User-Generated Content, it may, at its sole discretion, adopt the measures it deems appropriate;
(iv) If any court of competent jurisdiction rules that any provision of these Terms and Conditions for User-Generated Content is unenforceable, then that provision will be severed. Such ruling shall not impair the Terms and Conditions for User-Generated Content. The remaining provisions of this Terms and Conditions for User-Generated Content shall remain in full force and effect.
